Terms and conditions
Last updated June 1, 2026
These general terms and conditions of sale (hereinafter the "General Terms") apply to any purchase made by an internet user / natural person (hereinafter the "Customer") on the website https://www.duallis.com (hereinafter the "Site") from TWINSSHELLS, whose registered office is located at 40, rue Martin Brignaudy, Marseille (13007), France, email: contact@duallis.com, registered with the Marseille Trade and Companies Register under number 992 153 163 (hereinafter the "Seller").
IMPORTANT: Any order placed on the Site necessarily implies the Customer's unreserved acceptance of the General Terms.
Article 1. Definitions
The terms used below have, within these General Terms, the following meaning:
"Customer": refers to the Seller's contracting party, who qualifies as a consumer and/or non-professional as defined by French law and case law. Accordingly, it is expressly provided that the Customer acts outside of any regular business activity.
"Delivery": refers to the first presentation of the Products ordered by the Customer at the delivery address indicated by the latter when placing the order.
"Products": refers to all products presented and sold by TWINSSHELLS on the Site.
"Territory": refers to Metropolitan France and the French Overseas Departments and Territories (DOM/TOM), Europe and the rest of the world.
Article 2. Scope and general principles
The purpose of the General Terms is to govern the sale made between the Seller and the Customer in relation to the Products. They apply to all purchases made online on the Site, for as long as the Site is available online.
The General Terms are precisely dated and may be amended and updated by the Seller at any time.
The applicable General Terms are those in force at the time the order is placed.
Amendments made to the General Terms shall not apply to Product(s) already purchased.
Article 3. Acceptance of the General Terms
The Customer undertakes to read the General Terms carefully and to accept them before proceeding with payment for an order of Product(s) placed on the Site.
The General Terms are referenced at the bottom of every page of the Site by means of a link and must be consulted before placing an order. The Customer is invited to read carefully, download and print the General Terms, and to keep a copy.
The Seller advises the Customer to read the General Terms with each new order, the latest version of said Terms applying to any new order of Products.
By clicking on the first button to place the order and then on the second to confirm said order, the Customer acknowledges having read, understood and accepted the General Terms without limitation or condition.
Article 4. Purchasing Products on the Site
In order to purchase a Product, the Customer must be at least 18 years old and have legal capacity or, if a minor, be able to provide evidence of the consent of their legal representatives.
The Customer will be asked to provide identifying information by completing the form available on the Site.
The Customer can check the status of their order on the Site. Delivery tracking may, where applicable, be carried out using the online tracking tools of certain carriers. The Customer may also contact the Seller's sales department at any time by email, at contact@duallis.com, in order to obtain information on the status of their order.
The information that the Customer provides to the Seller when placing an order must be complete, accurate and up to date. The Seller reserves the right to ask the Customer to confirm, by any appropriate means, their identity, their eligibility and the information provided.
Article 5. Orders
Article 5.1 — Product characteristics
The essential characteristics of the products are set out in the Product tabs and information sheets available on the Site, generally containing a 3D photograph of the product and indicating its specific features.
The detailed product sheet is the sole contractual source.
The Customer undertakes to read this information carefully before placing an order on the Site.
Unless expressly stated otherwise on the Site, all Products sold by the Seller are new and comply with European legislation in force and with the standards applicable in France.
The Seller's suppliers may change the technical composition of the products without notice, and the Seller is entitled at any time to update or improve its technical sheets or to withdraw its Products from sale.
Article 5.2 — Ordering procedure
Orders for Products are placed directly on the Site. To place an order, the Customer must follow the steps described below (please note, however, that depending on the Customer's starting page, the steps may differ slightly).
5.2.1 — Product selection and purchase options
The Customer must click on the "Customize your Duallis" tab and then choose the customizable characteristics of the product (type of smartphones and colors) and the desired quantities. Once the options have been selected, the personalized Product is placed in the Customer's cart. The Customer may then add as many Products to their cart as they wish.
5.2.2 — Orders
Once the Products have been selected and placed in the cart, the Customer must click on the cart and check that the contents of their order are correct. If the Customer has not already done so, they will then be invited to log in or register.
Once the Customer has validated the contents of the cart, an order summary and information relating to the total amount of the order will be displayed.
The Customer is invited to check the contents of their order (including the quantity, characteristics and references of the Products ordered) before validating it.
The Customer may then proceed to pay for the Products by clicking on "Proceed to checkout" and following the instructions on the Site. The Customer must provide all information required for invoicing and Delivery of the Products. Orders placed must include all information necessary for the order to be processed correctly.
The order will only be definitively recorded once the various pieces of information have been entered and final validation has taken place. When a payment method is selected in order to record the order, the sale is deemed concluded.
5.2.3 — Acknowledgement of receipt
Once all the steps described above have been completed, a page appears on the Site acknowledging receipt of the Customer's order. A copy of the order acknowledgement is automatically sent to the Customer by email, provided that the email address given via the registration form is correct.
The Seller does not send any order confirmation by post or fax.
5.2.4 — Invoicing
During the ordering procedure, the Customer must enter the information required for invoicing.
In particular, the Customer must clearly indicate all information relating to Delivery, especially the exact Delivery address as well as any access code for the Delivery address.
The Customer must then specify the chosen payment method.
An invoice will be automatically generated when the Customer pays for the Product and sent to the email address previously indicated by the Customer when placing the order.
Whatever the ordering or payment method used, the Customer will receive the original invoice upon Delivery of the Products, inside the parcel.
Article 5.3 — Prices
The prices shown on the Site are stated in euros (€), inclusive of all taxes, delivery costs included.
The prices charged by the Seller's suppliers are subject to change. Consequently, the prices indicated on the Site may change. They may also be modified in the event of special offers or sales.
The prices indicated are valid, save for manifest error. The applicable price is the one shown on the Site on the date the order is placed by the Customer.
Article 5.4 — Product availability
The offers and Products indicated on the Site by the Seller are valid subject to availability from the Seller's suppliers.
The unavailability of a Product is in principle indicated on the page of the Product concerned.
Article 6. Right of withdrawal
The terms of the right of withdrawal are set out in the "Withdrawal Policy", available in Appendix 1 hereto and accessible at the bottom of the Site.
The Seller has set up a link accessible directly on its Site allowing the right of withdrawal to be exercised online.
Article 7. Payment terms
7.1. The Customer may pay for their Products online on the Site using the means offered by the Seller.
The Customer warrants to the Seller that they hold all the authorizations required to use the chosen payment method.
The Seller will take all necessary measures to guarantee the security and confidentiality of the data transmitted online as part of online payment on the Site.
It is specified in this respect that all payment information provided on the Site is transmitted to the Site's bank and is therefore not processed on the Site.
7.2. In the event of a single payment by credit card, the Customer's account will be debited as soon as the order for Products is placed on the Site.
7.3. If the bank refuses to debit a card or other means of payment, the Customer must contact the Seller's Customer Service in order to pay for the order by any other valid means of payment.
In the event that, for any reason whatsoever — objection, refusal or otherwise — the transfer of the funds owed by the Customer proves impossible, the order will be cancelled and the sale automatically terminated.
Article 8. Evidence and archiving
Any contract concluded with the Customer corresponding to an order in an amount greater than 120 euros including tax will be archived by the Seller for a period of ten (10) years in accordance with Article L. 213-1 of the French Consumer Code.
The Seller agrees to archive this information in order to ensure the traceability of transactions and to produce a copy of the order at the Customer's express request.
In the event of a dispute, the Seller will have the option of proving that its electronic tracking system is reliable and that it guarantees the integrity of the transaction.
Article 9. Retention of title
The Seller remains the owner of the Products until they have been paid for in full by the Customer.
The transfer of the risks of loss and deterioration occurs, irrespective of the transfer of ownership, at the time when the Customer or a third party designated by them, other than the carrier proposed by the Seller, takes physical possession of the products, in accordance with Article L. 216-3 of the French Consumer Code. Where the Customer chooses a carrier other than the one proposed by the Seller, the risk of loss or damage to the products is transferred to the Customer when the products are handed over to the carrier designated by the Customer. In all cases, the loss or deterioration of the products after the transfer of risk does not affect the Customer's price debt towards the Seller.
Article 10. Delivery
The terms of Delivery of the Products are set out in the "Delivery Policy" referred to in Appendix 2 hereto.
Article 11. Packaging
The Products will be packaged in accordance with the transport standards in force, in order to guarantee maximum protection for the Products during Delivery. It is specified that the packaging of the Products is not the direct responsibility of the Seller.
Customers undertake to comply with the same standards when returning Products under the conditions set out in Appendix 1 "Withdrawal Policy".
Article 12. Legal warranties
Article 12.1 — Warranty of conformity
The Seller undertakes to provide the Customer with a product that conforms to their purchase. The Customer may rely on the legal warranty of conformity provided for by the French Consumer Code, under the articles below:
- Article L. 217-4 of the French Consumer Code: "The seller shall deliver goods that conform to the contract and shall be liable for any lack of conformity existing at the time of delivery. The seller shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation where the latter was made its responsibility under the contract or was carried out under its responsibility."
- Article L. 211-5 of the French Consumer Code: "Goods conform to the contract:
- 1° If they are fit for the purpose usually expected of similar goods and, where applicable: if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; if they display the qualities that a buyer may legitimately expect having regard to the public statements made by the seller, the producer or its representative, in particular in advertising or labelling;
- 2° Or if they display the characteristics defined by mutual agreement between the parties or are fit for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter."
Any action resulting from a lack of conformity is time-barred two (2) years from delivery of the Product (Article L. 217-12 of the French Consumer Code).
In the event of a lack of conformity, the Customer may request the replacement or repair of the Product, at their choice. However, if the cost of the Customer's choice is manifestly disproportionate compared with the other available option, taking into account the value of the Product or the significance of the defect, the Seller may proceed with a refund without following the option chosen by the Customer.
In the event that replacement or repair proves impossible, the Seller undertakes to refund the price of the Product within thirty (30) days of receipt of the returned Product and in exchange for the Product being sent back by the Customer to the address that will be communicated to them by email.
Finally, the Customer is exempted from providing proof of the existence of the Product's lack of conformity for a period of twenty-four (24) months from delivery of the Product, unless proven otherwise. The Seller may rebut this presumption if it is incompatible with the nature of the Product or the alleged lack of conformity (Article L. 217-7 of the French Consumer Code).
It is specified that this legal warranty of conformity applies independently of any commercial warranty granted on the Product.
Article 12.2 — Warranty against hidden defects
The Seller is bound by the warranty against hidden defects in the Product sold which render it unfit for its intended use, or which so impair that use that the Customer would not have purchased it, or would have paid a lower price for it, had they been aware of them (Article 1641 of the French Civil Code).
This warranty allows a Customer who can prove the existence of a hidden defect to choose between a refund of the price of the Product if it is returned and a refund of part of its price if the Product is not returned.
In the event that replacement or repair proves impossible, the Seller undertakes to refund the price of the Product within thirty (30) days of receipt of the returned Product and in exchange for the Product being sent back by the Customer to the address that will be communicated to them by email.
Any action resulting from redhibitory defects must be brought by the Customer within two (2) years from the discovery of the defect (Article 1648, first paragraph, of the French Civil Code).
Article 13. Liability
13.1. The Seller's liability may under no circumstances be incurred in the event of non-performance or improper performance of contractual obligations attributable to the Customer, in particular when entering their order.
Under no circumstances may the Seller be held liable for any indirect, incidental, special or consequential damage and, in particular, without limitation, loss of business, loss of profit or loss of opportunity resulting from the purchase of Products on the Site. Defects and deterioration caused by natural wear and tear or by an external accident (incorrect assembly, faulty maintenance, abnormal use, etc.), or by a modification of the product neither provided for nor specified by the manufacturer, are excluded from the warranty.
13.2. The Products offered comply with French and European legislation in force. The Seller's liability may not be incurred in the event of non-compliance with the legislation of the country in which the product is used (for example, where a product is prohibited, etc.). It is the Customer's responsibility to check with local authorities the possibilities for importing or using the products they intend to order.
13.3. Photographs are provided for illustrative purposes only; the Customer must refer to the description of each Product to know its precise characteristics.
13.4. In the case of purchases made in a professional capacity, the Seller shall incur no liability for any indirect damage arising hereunder, loss of business, loss of profit, loss of opportunity, damage or costs that may arise from the purchase of the products. The total or partial impossibility of using the products, in particular due to hardware incompatibility, may not give rise to any compensation, refund or claim against the Seller. The Seller's liability may therefore not be incurred for any loss whatsoever resulting from a professional activity.
13.5. The Seller may not be held liable or deemed to have failed in its obligations hereunder for any delay or non-performance where the cause of the delay or non-performance is linked to an event of force majeure within the meaning of Article 1218 of the French Civil Code, that is to say an event beyond its control, which could not reasonably have been foreseen at the time the contract was concluded and whose effects cannot be avoided by appropriate measures.
The following are in particular considered to be events of force majeure (non-exhaustive list): war, armed conflict, geopolitical tensions, terrorism, riots, blockades, embargoes, sanctions, decisions by public authorities, border closures, import/export restrictions, major interruptions or disruptions to transport (sea, air, road), general strikes by carriers or logistics platforms, natural disasters, fires, epidemics/pandemics.
The prevented Party shall inform the other Party as soon as possible. Performance of the affected obligations is suspended for the duration of the impediment. If the impediment continues beyond a reasonable period, making performance lastingly impossible, the contract may be terminated for the unperformed part, with a refund of the sums collected in respect of that part.
Article 14. Intellectual property
14.1. All visual and audio elements of the Site, including the underlying technology used, are protected by copyright, trademark law and/or patent law.
These elements are the exclusive property of the Seller. Any person who publishes a website and wishes to create a direct hypertext link to the Site must request the Seller's prior written authorization. This authorization from the Seller will under no circumstances be granted permanently. Such a link must be removed at the Seller's request.
14.2. In addition, it is expressly recalled that the Seller holds the rights to the word mark "Duallis", registered with the French Official Industrial Property Bulletin under number 26/17 on April 24, 2026.
Article 15. Personal data
15.1. The Seller collects personal data concerning its Customers on the Site, including by means of cookies. Customers may disable cookies by following the instructions provided by their browser.
Detailed cookie management is set out in the Cookie Policy tab on the Site.
15.2. The data collected by the Seller is used in order to process orders placed on the Site, manage the Customer's account, analyze orders and, if the Customer has chosen this option, send them marketing emails, newsletters and promotional offers, unless the Customer no longer wishes to receive such communications from the Seller.
15.3. The Customer's data is kept confidential by the Seller for the purposes of the contract and its performance, and in compliance with the law. The Seller keeps it for a period of two (2) years after the Customer's last activity on the Site.
Detailed management of personal data is set out in the Privacy Policy tab on the Site.
Article 16. Recourse to the consumer ombudsman
The Customer has the right to have recourse, free of charge (excluding any lawyer's or expert's fees), to a consumer ombudsman with a view to the amicable resolution of a dispute arising in connection with the sale.
The Customer must first send their complaint by post to the following address: 40, rue Martin Brignaudy, Marseille (13007), or to the following email address: contact@duallis.com.
If this attempt fails, the Customer may have recourse to a conventional mediation procedure or to any other alternative dispute resolution method, in particular by referring the matter, free of charge, within one year of their complaint, to the Consumer Ombudsman.
To submit a dispute to the ombudsman, the Customer must:
- complete the form on the website https://www.mediation-vivons-mieux-ensemble.fr;
- send their request by ordinary or registered post to: Médiation – Vivons Mieux Ensemble, 465 avenue de la Libération, 54000 Nancy, France;
- or by email to: mediation@vivons-mieux-ensemble.fr.
Whatever means is used to contact Médiation – Vivons Mieux Ensemble, the request must contain the following: the Customer's postal address, email address and telephone number; the full name and address of TWINSSHELLS (set out at the top of the General Terms); a brief statement of the facts and evidence of the prior steps taken with TWINSSHELLS.
In accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has also made available to consumers a European online dispute resolution (ODR) platform accessible via the following link: https://ec.europa.eu/consumers/odr/.
If this mediation fails, or if the Customer does not wish to use it, they remain free to submit their dispute to the competent courts.
Article 17. Governing law and competent courts
The General Terms are governed by French law. They are drafted in French. In the event that they are translated into one or more languages, only the French text shall prevail in the event of a dispute.
Any claim or dispute arising from the validity, interpretation or performance of the General Terms shall be submitted to the competent courts within the jurisdiction of the Court of Appeal of Aix-en-Provence, under ordinary law conditions.
In accordance with Article R. 631-3 of the French Consumer Code: "The consumer may bring proceedings before either one of the courts with territorial jurisdiction under the Code of Civil Procedure, or the court of the place where they resided at the time the contract was concluded or the harmful event occurred."
Appendix 1 — Withdrawal Policy
Principle of withdrawal
As a matter of principle, the Customer has the right to send back or return the Product to the Seller or to a person designated by the latter, without undue delay and at the latest within fourteen (14) days following notification of their decision to withdraw, unless the Seller offers to collect the Product itself.
Withdrawal period
The withdrawal period expires fourteen (14) calendar days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Product.
Where the Customer has ordered several Products in a single order giving rise to several Deliveries (or in the case of an order for a single Product delivered in several batches), the withdrawal period will expire fourteen (14) calendar days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the last Product delivered.
Notification of the right of withdrawal
To exercise their right of withdrawal, the Customer must notify their decision to withdraw from this contract by means of an unambiguous statement sent to: contact@duallis.com or to the address: 40, rue Martin Brignaudy, Marseille (13007), France.
They may also use the form below:
WITHDRAWAL FORM

I hereby give notice of my withdrawal from the contract for the sale of the Product below:
- Product reference: __________________
- Invoice no.: ______________________
- Order form no.: __________________
- Ordered on ____________ / received on ________________
- Payment method used: ___________________________
- Name of the Customer and, where applicable, of the order beneficiary: ____________________________
- Customer's address: _______________________________
- Delivery address: ______________________________________
- Customer's signature (except where sent by email): _______________________________________
- Date: ______________________________________
For the withdrawal period to be respected, the Customer must send their communication concerning the exercise of the right of withdrawal before the withdrawal period expires.
Effects of withdrawal
In the event of withdrawal by the Customer, the Seller undertakes to refund all sums paid, including delivery costs, without undue delay and in any event no later than fourteen (14) days from the day on which the Seller is informed of the Customer's decision to withdraw.
The Seller will issue the refund using the same means of payment as the one used by the Customer for the initial transaction, unless the Customer expressly agrees to a different means; in any event, this refund will not incur any costs for the Customer.
The Seller may defer the refund until receipt of the goods or until the Customer has provided proof of dispatch of the goods, whichever is the earlier.
Return procedure
The Customer must, without undue delay and in any event no later than fourteen (14) days after notification of their decision to withdraw from this contract, send the goods back to the address that will be communicated to them by email.
This deadline is deemed to have been met if the Customer sends the goods back before the fourteen-day period expires.
Return costs
The Customer must bear the direct cost of returning the goods.
Condition of the returned goods
The Product must be returned in accordance with the Seller's instructions and must in particular include all accessories delivered.
The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of that Product. In other words, the Customer may test the Product, but may be held liable if they handle it beyond what is necessary.
Appendix 2 — Delivery Policy
Delivery zone
The Products offered may be delivered in Metropolitan France, in Europe and in the rest of the world. The Products are shipped to the delivery address(es) indicated by the Customer during the ordering process.
Dispatch time
The times required to prepare an order and then issue the invoice, before the Products are dispatched, are stated on the Site. These times exclude weekends and public holidays.
An email will be automatically sent to the Customer when the Products are dispatched, provided that the email address given in the registration form is correct.
Delivery times & costs
During the ordering process, the Seller informs the Customer of the possible delivery times and shipping options for the Products purchased.
Shipping costs are included in the Product price shown on the Site.
The Seller undertakes to deliver the Product to the Customer within a period not exceeding three (3) months from the expiry of the fourteen (14) day withdrawal period.
It is specified that the average time for an order is estimated at one month from the expiry of the fourteen (14) day withdrawal period.
These times are explained by the customizable nature of the Product purchased by the Customer, who makes several option choices in order to create an almost made-to-measure Product.
It is specified that delivery times are given as an indication only and may vary by a few days. They are subject to carrier constraints and fall under the carrier's responsibility; a delay may under no circumstances give rise to cancellation of the order or a claim for damages against the Seller. Events of force majeure — natural disaster, pandemics, shortages, strikes and all causes provided for in the French Civil Code — which cause delays in the production and/or delivery of the products ordered may not incur the Seller's liability for the total or partial non-performance of its contract.
The Seller's liability ends from the moment the goods are entrusted to the carrier, and the Seller may not be held liable for missing, lost or damaged items.
Delivery times are calculated on the basis of business days and do not include holiday periods or national public holidays.
Customers located outside Metropolitan France are responsible for the formalities relating to importation into their country.
Upon receipt of the goods, the Customer is advised to systematically check the number of parcels and the condition and contents of the delivery. In the event of a dispute, it is the recipient's responsibility to record reservations with the carrier without delay and in detail in order to preserve their rights.
Delivery methods
When arranging delivery, the Customer chooses one of the delivery methods offered: (i) home delivery, (ii) pickup point or (iii) any other method offered by the carrier.
If the Customer is absent, a delivery notice will be left so that they can collect their parcel from their post office.
Delivery address
When the Customer makes a purchase on the Site, they accept and acknowledge that they must provide a valid email address and a shipping address for the order. It is the Customer's responsibility to provide a complete and valid shipping address.
In the event of an error and of delivery being impossible for the carrier because of an address error on the Customer's part, the Seller will wait to receive the parcel returned to sender and will refund the value of the order, less €12 in logistics and Delivery costs.
Delivery problems
The Customer is informed of the delivery date set at the time they choose the carrier, at the end of the online ordering procedure, before confirming the order.
It is specified that deliveries will be made within three (3) months from the expiry of the fourteen (14) day withdrawal period. Failing this, the Customer must give the Seller formal notice to deliver within a reasonable period and, in the event of non-delivery within that period, may terminate the sale.
The Seller will refund the Customer, without undue delay from receipt of the termination letter, the total amount paid for the Products using the same payment method as the one used by the Customer to purchase the Products.
The Seller is liable until the Product is delivered to the Customer. In the event of damage or partial loss, the Customer is entitled to refuse the parcel but must expressly record a reservation with the carrier. It is recalled that the Customer has three (3) days from actual delivery to notify the carrier of any damage or partial loss observed upon delivery.
